New Delhi: The Supreme Court is likely to take a call on Wednesday on the petition filed by Akhilesh Yadav, son of Uttar Pradesh Chief Minister Mulayam Singh Yadav, seeking a review of its March 1 order, asking the CBI to conduct a preliminary inquiry in the disproportionate assets case against his father and family members.
Mulayam Singh Yadav, his two sons Akhilesh Yadav and Prateek Yadav and his daughter-in-law Dimpal Yadav are facing allegations of acquiring assets worth over Rs 100 crore through corrupt means by misusing his status as state the chief minister.
Akhilesh Yadav, a Lok Sabha member, has sought a stay on the CBI inquiry till the UP Assembly elections are over. He has also appealed to the court that the inquiry be conducted by a retired Supreme Court or High Court judge instead of CBI as he has no faith in the Central investigating agency.
The impartiality of the CBI in investigating political cases has been under cloud for sometime now, he has pointed out. His petition also demands that the CBI be directed to await the outcome of the ongoing inquiry by Income Tax department against his father.
The Supreme Court passed the directive to the CBI on a petition filed by Vishawnath Chaturvedi, a Congress activist, who has sought prosecution of the SP supremo and his family members under the Prevention of Corruption Act.
Mulayam Singh has refuted the allegations as politically motivated, designed to tarnish his political reputation with an eye on the Assembly elections.
The petition of Akhilesh Yadav will be heard by a Bench comprising Justices CK Thakker and Altamas Kabir.
Justice A R Lakshmanan, who has since retired, had earlier withdrawn from the case after he broke down in the open court, saying that he had received an anonymous letter casting aspersions on his integrity.
