BANGALORE: The High Court on Tuesday directed the UPSC to file a memo stating that it has complied with Tamil Nadu and Andhra Pradesh High Court orders while selecting a candidate for the post of state police chief and adjourned the further hearing on the petition filed by ADGP (Railways) Shankar Bidari to Wednesday.
Shankar Bidari appeared before the court and contended that the pay rules do not have any role in selecting the DG IGP of the state. If the pay rules are applied to select the candidate for the post, the Supreme Court verdict on the issue in Prakash Singh's case will become invalid, as according to the guidelines issued by the Supreme Court, the officers who have served for 30 years are eligible for selection. Moreover, the UPSC should select a candidate from the three empaneled candidates and not from the three senior candidates as contended by the respondents, he argued.

If the pay rules are applied as submitted by the respondents, the UPSC will not have any choice to select a candidate as in 24 out of 26 states and Union territories there are not more than two or three candidates who are in the HIG category and serving as DGPs. If pay rules are applied, only a candidate with seniority would be selected and not meritorious. The move to ask the state government to send the names of nine officers who have served for thirty years and more is in accordance with the Supreme Court's order, he contended.
