New Delhi: A Delhi court, under the Domestic Violence (Prevention) Act, has ordered the in-laws of a woman to hand over the custody of a child to her temporarily.
In the first case to be decided in the national capital under the Act, the court asked a Protection Officer, appointed under the law, to ensure compliance of the order and seek police assistance if required to implement it.
"Sunil Kumar (husband) and Asha Rani (mother-in-law) are directed to hand over the temporary custody of the child who is below the age of five years till the disposal of a petition under the Hindu Marriage Act or any other order by the competent court," Metropolitan Magistrate D K Jangala said as quoted by PTI.
The complaint filed by one Neeraj Bala under the Domestic Violence (Prevention) Act 2005, which came into force in October last year, was disposed off within two months.
The woman, a resident of Nangloi in New Delhi, had filed a complaint in the court on November three seeking custody of her child and compensation from her in-laws.
She also sought compensation alleging that after her marriage with Sunil in the year 2000, she had been ill-treated by in-laws and the husband for dowry demands.
The court however held that since no details with regard to the compensation had been furnished by the complainant, no order was required to be passed.
But the Metropolitan Magistrate restrained the husband and mother to maintain any communication with the complainant.
"As it is admitted that they (husband and mother) have shifted to Maharashtra in the year 2005, there is no immediate apprehension of domestic violence by them. However, there are reasonable apprehensions of harassing the complainant by way of communication," the Judge said.
