BANGALORE: The issue of appointment of the Karnataka DG & IG took another turn on Thursday with Chief Justice of the High Court Justice Vikramjit Sen referring Bidari’s case back to the Division Bench which heard it first, and the incumbent DG & IG, A R Infant, filing a contempt petition against Bidari. Bidari, who is currently DG and Chairman of Karnataka State Police Housing Corporation, had filed an application in the HC seeking a change of Bench to hear his petition challenging his removal from the top police post. He had said the views expressed by the Bench headed by Justice N Kumar earlier might not be changed.The Bench, then, asked the HC Registry to place all material pertaining to the case before the Chief Justice.Hearing Bidari’s application on Thursday, Justice Sen said, “This kind of applications are biased, and it seems like you (Bidari) are hunting for an appropriate Bench. Even the Supreme Court has directed advocates and litigants not move such applications. This one is enough to demolish the judicial system.”When Justice Sen asked Bidari who first mentioned the name of Gaddafi, the counsel for the petitioner said he mentioned in the petition that “Bidari was not like Gaddafi or Saddam, and that he had to report to four DGPs and two states during the operations against forest brigand Veerappan”.For that, Justice Sen said, “It was you who used Gaddafi’s name first. It was not the judge who used that name. The Division Bench has not recused itself from hearing this case, so I am placing the matter before the same Bench.”When the matter came up for hearing before the Division Bench in the afternoon, Infant filed a contempt petition against Bidari for seeking a change of Bench and making a “comment” on the judiciary, stating that it amounted to contempt of court.Hearing the petition, the Bench directed Bidari to file his objections to the contempt petition and adjourned the matter till Friday.HC Stays Doctors’ PG Admission CounsellingThe Karnataka High Court on Thursday stayed the counselling for admission of working doctors to post-graduate (PG) courses and ordered that status quo be maintained in admissions that are already done.Hearing a petition by Dr Sonia and 10 others, Justice Ashok B Hinchigeri stayed the counselling and asked the government to file objections.The appellants had stated that according to the regulations for counselling of admission of working doctors to PG courses, one has to work for a minimum of six years, but the state government amended the regulation in January 2012, which is affecting those doctors who have already put in served six years of duty. They contended that this amendment will benefit only newcomers and be unjust to those who have worked for six years.HC Seeks Clarification on Water ProjectThe High Court on Thursday directed the state government to clarify on providing drinking water in connection with a public interest litigation seeking water supply to Pavagada, Madhugiri and Sira taluks through the pipeline laid for the Neelakantapuram Srirami Reddy Water Project in Andhra Pradesh from Tungabhadra Dam (TB Dam), Hospet.The state government stated in an affidavit that the project, which is a joint venture of Andhra and Karnataka, will pass through Pavagada. Hearing the petition, a division bench comprising Chief Justice Vikramjit Sen and Justice B V Nagarathna directed the state government to clarify on the issue during the next hearing.
