Ahmedabad: The Supreme Court on Friday stayed the Gujarat High Court order, which had transferred the Ishrat Jahan fake encounter case to the Special Investigation Team (SIT).

The order came on a petition filed by Ishrat Jahan's mother saying the High Court had no authority to hand over the case. She further demanded a CBI probe.

The apex court may have taken the decision because the SIT is not a statutory body. The SIT was constituted to investigate communal riots and not fake encounters.

Nineteen-year-old Ishrat, a 2nd year BSc student, was gunned down along with three others by Gujarat Police in an encounter on June 15, 2004. All four were accused of being LeT terrorists, who were plotting to kill Gujarat Chief Minister Narendra Modi. Later, a magisterial report said that Ishrat and her friends were killed in a fake encounter.
