SC names special public prosecutor in 2G case
The apex court said it was issuing the direction in the interest of "substantive justice".

New Delhi: Overruling the Central Government's objection, the Supreme Court on Monday appointed senior counsel Uday Lalit as special public prosecutor for the Central Bureau of Investigation (CBI) in the 2G scam case.

Justice GS Singhvi and Justice Asok Kumar Ganguly said they were issuing direction in the interest of substantive justice. Article 142 of the constitution empowers the court to take any step for securing "substantive justice".

The apex court said any application or objection to the proceedings of the special court set up to hear the 2G scam case will only be brought before it. It said the case will be heard on a day to day basis.

The Central Government had objected to the appointment of Uday Lalit as special public prosecutor, It said under the Prevention of Corruption Act and the Prevention of Money Laundering Act, it was within its domain to appoint a person to the post.

But the Supreme Court overruled this on Monday.

The 2G scam relates to irregularities in the allocation of second generation (2G) spectrum to telecom companies that allegedly caused huge losses to the exchequer.
