CUTTACK: The Justice AS Naidu Commission of Inquiry into the alleged assault on a judicial magistrate by a police officer in Rourkela last year, on Sunday issued notices to the main parties under Section 8B of the Commission of Inquiry Act. Holding its 33rd sitting here, Justice Naidu directed the then IIC of Uditnagar police station, Rourkela, Sadananda Pujari, the then additional SP Ramkumar Panda, sub- inspector Tushil Kumar Majhi, the then SP Diptesh Patnaik, the then judicial magistrate Arun Kumar Patnaik and the DSP (home Guard) Suresh Chandra Padhi to file their response by May 29. The next sitting has been fixed on June 2. The Commission observed that notices were necessary to allow the persons an opportunity to make their submissions. The Section envisages that when any Commission of Inquiry wants to make any adverse observation against any person, then it is required to provide an opportunity of hearing to those persons. Accordingly, the notices were issued to the parties to have their say with reference to the statements made against them by various persons during examination and cross examinations. The Commission also rejected the petition filed by advocate Ramesh Chandra Bal praying for grant of further time to appear before it. The Commission observed that he was granted an opportunity to appear on six dates but he failed to do so. However, while rejecting the application, the Commission offered him the chance to appear on June 2 and face cross examination. The Commission had also earlier issued notice to another advocate Akshay Kumar Das to appear before it on Sunday and face cross examination. However, as he did not appear, his petition was dispensed with. So far the Commission has dealt with 42 out of the 43 witnesses in the case.
