KOCHI: The Election Commission of India on Wednesday submitted before the Kerala High Court that the Piravom byelection would be held before April 30. Counsel for Election Commission B Murali Purushothaman submitted that as per Section 151 A of the Representation of the People Act, a byelection for filling any casual vacancy in the Assembly shall be held within a period of six months from the date of occurrence of the vacancy. The elected representative of the Piravom constituency passed away on October 30 and the six month period would be completed only on April 30, he said. “The Commission has been conscious of the statutory obligation provided in the Act and will announce the schedule after taking into consideration all relevant aspects at the appropriate time. “There will not be any delay in the announcement of the schedule,” the Commission said. Justice S Sirijagan recorded the submission and disposed of the petition filed by K K Joy of Pampra seeking a directive to announce and hold the Piravom byelection at the earliest. The Commission added that as on November 30, 2011, there were ten casual vacancies in various Assemblies across the country. The byelections in those constituencies have not been announced yet, the Commission said.
