The High Court on Thursday stayed the tender notification for the maintenance and operation of Nirmala toilets following the irregularities in allotting tenders and directed to call a fresh tender notification.
A Division Bench comprising Chief Justice Vikramjit Sen and Justice B V Nagarathna passed this order based on a public interest litigation alleging the Bruhat Bengaluru Mahanagara Palike (BBMP) of giving 50 percent reservation to the SC/ST applicants, which is against the Constitution.
Lakshmi Prasad filed the petition.
The Bench allowing the contentions of the petitioner observed, “We think it is appropriate to stay that portion of the tender notification, which reserves certain toilets to certain sections only. The BBMP should withdraw the notification so that a fresh notification can be published in which public can be invited to apply.”
