New Delhi: Raising doubts about the honesty of probe into Jessica Lall murder case, Ram Jethmalani, the lawyer of Manu Sharma, on Thursday said the Delhi High court may order a retrial of the case if it finds that the investigation was ‘corrupted’.
Concluding his arguments in defence of Sharma, Jethmalani told a Division Bench of Justice R S Sodhi and Justice P K Bhasin that prosecution has ‘invented’ the circumstances to falsely implicate his client and ‘if the court finds that the investigation is corrupt it can direct for retrial of the case’.
"There is doubt about the honesty of the investigation in this very case. When investigation is doubtful, then the whole case goes," the counsel argued.
To this, Justice Sodhi asked why Sharma was targeted out of 100 people who were there in the party of the fateful night.
"Why they chased you only and framed? There were hundred people around in the party. How important you are for them or what enemity police has with him?” Justice Sodhi said.
Jetmalani charged the police had deliberately allowed the culprit to flee the place of occurrence soon after the incident took place and the guilty might be Sharma's enemy who has given his name to the police.
Model Jessica Lall was shot dead allegedly by Sharma after she had refused to serve him liquor during a party at Tamarind Court restaurant of Qutub Collonade on the intervening night of April 29-30, 1999.
