BANGALORE: The High Court on Tuesday adjourned further hearing on the five applications filed by advocate Sirajin Basha, requesting the court to vacate the stay granted by it to the proceedings in the lower court in the five cases filed by him against Chief Minister B S Yeddyurappa and his relatives for committing various irregularities, including land grabbing.Appearing for Sirajin Basha, advocates C H Hanumantharayappa and Asmadh Basha submitted before the court that the police will not have any power to arrest the accused if the magistrate orders an inquiry into the cases and the duty of the police is only to assist the court by collecting evidence and presenting it to the court as and when needed.The police can arrest the accused only with the court’s permission and with a warrant issued by the court.The advocates submitted a precedent set by one of the High Courts to substantiate their claim.
