A judge filed a complaint against a woman for retracting from her earlier statements that she was criminally assaulted.

New Delhi: A judge, who held the trial of a rape case, has filed a criminal complaint before a Delhi Court against a woman for retracting from her earlier statement given before a Magistrate that she was criminally assaulted.

Additional Sessions Judge (ASJ) Reena Singh Nag filed a complaint under Section 193 (giving false evidence in a judicial proceeding) of the IPC against the woman who in her deposition during the trial said she was not raped at all.

"Her statement was also recorded by Metropolitan Magistrate Veena Rani under Section 164 of the CrPC wherein she stated on oath that accused Devinder Verma had raped her."

ASJ Nag said in the complaint lodged before Additional Chief Metropolitan Magistrate Sanjeev Jain.

"In her cross-examination by Additional Public Prosecutor (APP) for the state, she stated that she was making the statement with full responsibility without being misled by anyone and further added that the accused was innocent," said the ASJ

seeking the woman's prosecution.

However, Nag, naming the APP as her representative, sought exemption from personal appearance as complainant before the Additional Chief Metropolitan Magistrate (ACMM).

The complaint had arisen from the case filed on November 30, 2005 by the woman alleging that she was raped several times by Verma with whom she had developed friendship following their regular interactions on telephone.
