Ishrat encounter case: HC hands over chargesheet to the accused

Ahmedabad: The Gujarat Hight Court has handed over the chargesheet to the accused in the Ishrat Jahan fake encounter case on Monday. In its chargesheet, the Central Bureau of Investigation (CBI) has maintained that the 19-year-old was killed in a fake encounter in a joint operation between Gujarat Police and the Intelligence Bureau.

Accused officers GL Singhal, Tarun Bharot and JG Parmar appeared in court and the chargesheet was handed over to them. One of the accused senior IPS officers, PP Pandey, though remains absconding. The CBI had filed the chargesheet on July 3 against seven policemen in the encounter case.

The CBI has handed over the chargesheet to the court but remained silent on whether Ishrat was a terrorist or not. The chargesheet claimed that eight Gujarat top policemen including ADGP PP Pandey, DG Vanzara, GL Singhal and five others were part of the murder and abduction conspiracy. However, Chief Minister Narendra Modi and his close aide Home Minister Amit Shah has not been named in the chargesheet. IB officer Rajinder Kumar, too, has not been named in the chargesheet as accused.

According to the CBI chargesheet, Ishrat Jahan and three others were kept in illegal confinement, put on tranquilizer before they were killed in cold blood on June 15, 2004.

Senior IPS officer DG Vanzara and other Gujarat police officers collected weapons from the Intelligence Bureau (IB) office and then planted them on Ishrat and others. The chargesheet said on Vanzara's instructions, suspended IPS officer GL Singhal went to the IB office on June 14 and collected a bag of weapons used in the encounter.

According to the CBI, IB officer Rajinder Kumar was heading state investigation bureau during the period when the encounter was carried out.

Gujarat Police officers were deployed in different places in the name of nakabandi (pickets) in Ahmedabad to manage the encounter, the chargesheet said. Charges of murder, kidnapping and illegal confinement against eight Gujarat Police officers including Vanzara have been slapped by the CBI.

The CBI chargesheet also said that Kumar and Pandey interacted with Ishrat and Javed at Khodiyar farm a few days before the encounter which conclusively proves that she was abducted by Gujarat Police officers NK Amin and Tarun Barot from Vasad toll booth.
