HYDERABAD: Justice PV Sanjay Kumar of the AP High court set aside a notification issued by the endowments commissioner seeking to alienate about 3 acres of land belonging to Jhamsi temple near Gudimalkapur market area in favour of one Kshatriya Seva Sangham. The judge allowed a writ petition filed by one Madhav Reddy and certain other local residents questioning the said notification as illegal and contrary to the rules. The notification had called for objections if any against the intended alienation. The petitioner successfully pointed out that the rules required that such lands can only be alienated by public auction and if the said procedure is not being followed then the executive officer would have to record his reasons. The judge, who called for the file, noticed that the entire action was initiated on a representation to the then chief minister who directed the authorities ‘to do the needful’.The judge rejected the plea saying that the objections can still be filed and the same would be considered by the authorities. He found that since the notification itself was invalid and the question of citizens responding to it did not arise.Govt Asked to Respond to Plea on Beer Procurement Policy Justice Ashutosh Mohanto of the AP High Court granted time to the state government to respond to a writ petition questioning the new policy of the state government on the procurement of beer. Arthos Beverages a Chennai based company, moved the High Court contending that the new policy that would come into place from September 1 was illegal.Under the present policy the government would procure beer for its sale through the Beverage Corporation, based on the sales figures of a particular brand across the country.In the present policy the government would be dictated by consumption indications from the state and not the country. The policy now stated is in a way a return to the earlier policy. In the last excise year, the government then headed by K. Rosaiah had shifted to the national figures as the basis. This was challenged then as being directed to favour a particular set of manufacturers.Appointment of In-charges for Local Bodies Justice Naushad Ali granted time till Monday to the government to support its order permitting the district collectors to proceed with the appointments of personsin charge to the various local bodies where the term of office of the elected officers had expired. The judge was dealing with a writ plea filed by L. Manikant and 19 other MPTC members from Krishna, Guntur, Karminagar and Praksam districts.Though it is common knowledge that an earlier petition on this issue was dismissed by a bench of the court, the judge would still proceed to hear the matter.This comes in the light of the fact that the petitioners have raised the issue that the appointment of persons incharge cannot be at the instance of the district collectors and any such delegation would require a gazette notification.
