The Bengaluru additional city civil and sessions court on Wednesday set aside an earlier order, according to which, former Kerala chief minister Oommen Chandy and five others were to give Rs 1.61 crore to a Bengaluru-based businessman in connection with a solar fraud case. Oommen Chandy is one of the six accused in the case, filed by M K Kuruvilla.
Oommen Chandy approached the court, stating that the order was ex parte and his version was not heard. The case was adjourned by the court for a January 9 hearing.
Now, judge M R Chennakeshava has set aside the October 24, 2016, order, and said that the hearing will begin on June 1, 2017, so that both sides could present their case.
In the petition, Kuruvilla has alleged that an amount of Rs. 1.35 crore was collected from him by a firm named SCOSSA educational consultants in different installments during 2011-12.
The complaint was that the amount was given to get the license and subsidy from central and state governments for importing solar technology from south Korea. It is said that Chandy allegedly spoke to Kuruvilla over the phone.
Oommen Chandy said that the court had not heard his version in this case and that the order was ex parte. He added that he does not have any relative by the name Andrews or any personal assistant by the name Diljith.
In a statement, Chandy said, "After I got a notice regarding the case earlier, I engaged a lawyer. But thereafter, no notices were received. I am sure that I could prove my innocence in the case. Further steps in this regard will be initiated soon."
