According to the bill, declaration of assets should be made a statutory responsibility of judges.

New Delhi: A Standing Committee report on the Judicial Accountability Bill was presented in Parliament on Tuesday. According to the Bill, judges should restrain from making unwarranted comments against constitution statutory body while hearing cases.

The judgement is regarding the need to change behaviour of judges within the purview of judicial standards. According to the bill, declaration of assets should be made a statutory responsibility of judges.

Mechanism to ensure scrutiny of assets and declarations should be set up. Three organs of the government: executive, judicial and legislature should be represented in the National Judicial Oversight Committee which will investigate and recommend action against an erring judges.

Appointment of Judges Committee has made recommendation that an independent mechanism national judicial commission be set up for appointment of judges.

Terming such remarks by judges as "unfortunate", the Parliamentary Standing Committee on Law and Justice and Personnel looking into the Judicial Standards and Accountability Bill, 2010, is learnt to have recommended that "there is a need to bring such behaviour of judges within the purview of judicial standards".

"The Committee feels that Clause 3 (2) (f) should be expanded by specifically mentioning that judges should restrain themselves from making unwarranted comments against other constitutional/statutory bodies/institutions/persons in open court while hearing cases," the committee is understood to have said.

The Committee had also suggested inclusion of two non-judicial members as part of the proposed National Judicial Oversight Committee authorised to initiate probe into allegations of corruption against senior judges.
