CUTTACK: The Crime Branch (CB) of Odisha Police has stated that criminal liability is well made out against the then inspector-in-charge of the local police station in the alleged gangrape case in Pipili.The CB submitted its affidavit before the Orissa High Court on Wednesday. In his affidavit, Crime Branch DSP and Investigating Officer R C Sethi said it is prima facie made out that Amulya Champatiray, the then IIC, was negligent in attending to the matter to secure justice for the victim, who belonged to the Scheduled Caste (SC) community.The IIC wilfully neglected his duty in connection with the offence committed against the girl as a result of which prompt police action and consequent medical treatment could not be provided to her, the report said. It added that criminal liability against Champatiray is prima facie made out to submit chargesheet against him under Section 4 of the SC/ST (Prevention of Atrocity) Act. The CB has proposed to submit chargesheet against him in the next few days.The investigating agency, however, has not come to a conclusion about the criminal liability of the doctors, who were associated in the process of treatment since it was waiting for certain clarifications from the Director of Medical Training and Education.In the report, the CB said the DMET had been requested to constitute a team of doctors and give its findings. A nine-member expert team submitted its report on the treatment of the victim vis-a-vis the role of the doctors in different stages. “Although the team has ruled out negligence/liability in the broader spectrum, in the body of the report, some adverse findings have been given against some doctors,” it said.After receiving the report, the IO made some queries from the DMET which has not come its way as yet. The clarifications are still awaited and therefore to ascertain the specific criminal liability of the individual doctors of Pipili Hospital, Capital Hospital and SCB Medical College, the investigation has been kept open under Section 173 of the CrPC, the CB said and prayed for three weeks time for completion of further investigation.
