The Delhi High Court recently granted bail to a member of the Lawrence Bishnoi gang in case registered against him under the charges of attempt to murder, assault on public official and certain other sections of the Indian Penal Code and Arms Act.
A single judge bench of the high court presided over by Justice Navin Chawla granted bail to Neeraj alias Kariya on a personal bail bond of Rs 50,000 with one surety of like amount.
“In case the Applicant is found to be involved in another case while being released on bail, it will be open to the prosecution to file an appropriate application seeking cancellation of his Bail in the present case as well,” the bench said in its order.
The prosecution’s case was that on March 5, 2023, information was received in the Special Cell/SR that the applicant is coming to meet his associate near Qutub Minar Metro Station between 2 am and 3 am. Accordingly, a trap was laid at the said spot and at about 2:40 am, one person was spotted while he was de-boarding from TSR near the above station.
“He was signaled to stop by the members of the team, however, the said person pulled out his pistol and fired two rounds on the raiding party. Members of the Police party also fired two rounds in their self-defence so as to overpower him. No one was, however, injured in this exchange of fire. The applicant was eventually overpowered and disarmed by the Police,” the prosecution argued.
Countering these submissons, Advocate Nitin Saluja along with Advocate Simran Khurana and Sanskriti argued there is a discrepancy in the timing of the case set up by the prosecution.
“While it is the case of the prosecution that the applicant was apprehended at 03:00 am, the GD entry was made only at 06:39 am, and the applicant was shown to be formally arrested at 09:00 am,” Saluja told the court.
Considering the submission of both the sides and noting that the accused has been in jail for over an year and the charges have not been framed, the bench found it be a fit case for bail.
