New Delhi: The Delhi High Court on Thursday cancelled the bail granted to a youngster accused of entering the home of a woman lawyer and attacking her with an iron rod, saying the trial court was "plainly in error" when it granted him relief.
Justice S Muralidhar set aside the June 5 order of the additional sessions judge (ASJ) saying the offence that the 25-year-old youngster allegedly committed was "serious" and "required" his custody.
The court directed accused Mukesh to surrender by 5 pm on Thursday and said the ASJ "was plainly in error to grant bail within one day of arrest".
Referring to the medico-legal certificate (MLC) of the victim, the court also said the ASJ "was in error" to say the victim had no head injury.
It said that the order of ASJ "erroneously recorded" that as per medical records the victim suffered no head injury.
According to the MLC, the victim had suffered several injuries, including one to her head which required 10 stitches, the court noted.
Senior advocates Siddharth Luthra and Kirti Uppal, appearing on behalf of the victim, argued that it was a fit case for cancellation of bail.
This contention was supported by the counsel for Delhi police as well who said that they have now also added charges under section 354B (assaulting woman with intent to disrobe) of IPC against the accused.
The FIR was lodged against the accused under sections 452 (trespass), 323 (causing hurt) and 354 (molestation) and 308 (attempt to commit culpable homicide) of the IPC.
Luthra said that the victim has sent a letter to Police Commissioner to add charges under section 376/511 (attempt to rape) of IPC, and the representation is pending.
