The CBI lawyer told the court that he cannot be prosecuted without sanction as he is a former CM, Revenue minister and a sitting MLA.
Mumbai: The Bombay High Court while hearing the revision petition filed by the CBI seeking to delete Ashok Chavan's name from the Adarsh FIR on Wednesday asked the agency whether sanction was indeed to prosecute Chavan.
The CBI lawyer told the court the agency cannot proceed to prosecute him under Prevention of Corruption Act without sanction as he is a former Chief Minister, Revenue minister and a sitting MLA.
Earlier the trial court had refused to drop Ashok Chavan's name despite the Governor's refusal to give sanction to prosecute him. The court has posted the matter for June 10 after issuing notices to Chavan and the Maharashtra government.
Ashok Chavan is contesting from Nanded in the Lok Sabha elections as Congress candidate.
