New Delhi: The Supreme Court has questioned the role of the Maharashtra Police in probing the criminal defamation complaint against Congress vice president Rahul Gandhi over his reported statement blaming "RSS people" for the assassination of Mahatma Gandhi.

The question arose as the local magistrate had referred the complaint against Rahul to the police to investigate. In criminal cases the police have no role to play, the judges said before adjourning the matter to August 23.

Last Tuesday, the two-judge bench had asked Rahul to either apologise or face trial for his remarks against the Rashtriya Swayamsevak Sangh.

The controversial statement was made at a public rally at Sonale in Bhiwandi on March 6, 2015. "RSS people killed Gandhiji and today their people (BJP) talk of him...They opposed Sardar Patel and Gandhiji," he had said.
