New Delhi: Bollywood superstar faced a case for 13 years in the 2002 hit-and-run case. He was accused of drunken driving and causing an accident which led to the death of one person and a few others were injured.
But what does the laws say? All automobile accident cases are tried under Section 304 or 304 A of the Indian Penal Code.
Section 304 (ii) is a more serious charges and is applied when the act is done with the knowledge that the action can cause death. The punishment is 10 years in jail.
Section 304A is a less serious charge and is applied when death is caused due to rash or negligent driving. The punishment is 2 years jail term.
Earlier, Salman khan was charged under Section 304A but subsequently the charge was enhanced to 304(ii) and the actor was tried by a sessions judge.
In May 2015, trial court has found Salman Khan guilty of culpable homicide not amounting to murder and he was sentenced to 5 years in jail.
Other sections are Section 279 in case of rash and negligent driving, Section 337 for causing hurt by act of endangering life, Section 338 for causing grievous hurt, Section 427 for mischief causing damage to property.
Section 185 of Motor Vehicles Act is applied when the person is driving vehicle after consuming alcohol.
