KOCHI: The Kerala High Court on Wednesday dismissed the petition challenging the election of CPM candidate K V Abdul Khader from the Guruvayur constituency. Justice M Sasidharan Nambiar passed the order while considering the petition filed by Ashraf Kokkur of Malappuram who was the IUML candidate against Khader.Ashraf challenged the election on the ground of disqualification that Khader was holding an office of profit on the date of submission of nomination. The petitioner further said that he was holding the post of chairperson of the state Wakf Board and was drawing remuneration from the state exchequer.However, the court rejected the arguments made by the petitioner. Meanwhile, the court found maintainable an election petition filed by P V Anwar, the Left-supported independent candidate who was defeated by P K Basheer of the IUML from Eranad constituency.The court held that the election petition can be disposed of only after recording the evidence. As such, the court directed the parties to submit a list of witnesses to be examine within 10 days.The petitioner challenged the election of Basheer on the ground of corruption of practice under section 123(2)(II) and (4) of Representations of People Act. Anwar alleged that the UDF election committee had circulated 25,000 pamphlets stating that he was involved in the murder of one Manaf in 1995.
