New Delhi: Jaya Bachchan has lost her Rajya Sabha seat but guess what; she doesn't have to pay back the money she earned.

The controversy regarding her expulsion from the Rajya Sabha may take time dying but legal experts are sure that Jaya Bachchan will not have to pay the Government for her emoluments during her time as a Member of Parliament.

“There is no provision under the Constitution that says that Jaya Bachchan has to pay back. She has been disqualified from her seat and by paying back she doesn't get to save her expulsion. Under the Service Act there is no legal provision for anyone who has served an office to pay for what they drew, '' Constitutional expert P P Rao says.

As a Member of Parliament since 2004 Jaya Bachchan was entitled to a salary of Rs 12,000 per month and allowances that amounted to a little over Rs 5,000. But Bachchan's lawyer is sure that no such payment would be required.

Bachchan's lawyer Pradeep Kumar says, “There is no provision in the Constitution for any such payback. Even the Rajya Sabha secretary general is not sure if anything such exists. If the Rajya Sabha asks her to pay back, she will. She has no such issues.''

While political parties are keeping the tempo high on Bachchan's expulsion, there may just be some respite for Bachchan on this front at least.
