BANGALORE: The High Court on Wednesday adjourned further hearing of the applications filed by advocate Sirajin Basha requesting the court to vacate the stay issued by it to the proceedings in the lower court in the cases filed by him against the chief minister and his relatives for various irregularities.Appearing for Basha, advocate Asmadh Basha contended that the judge in the lower court had taken cognizance of the allegations made against the chief minister and his relatives and was taking sworn statements before proceeding further in accordance with law.The court need not take sanction of any authority to investigate the penal offences committed by elected representatives though they are considered public servants.However, the investigating agency has to take the permission of the Rajya Sabha Chairman or Parliament Speaker before framing charges against them.In the present case the investigation has not even started, as no FIR, has been filed in any of the cases till now.
